Court grants interim injunction pausing Rossland magnesium mine construction

Construction on the proposed Record Ridge mine near Rossland will be paused after the British Columbia Supreme Court granted an interim injunction to groups opposing the project.
The Save Record Ridge Action Committee Society (SRRACS) and Sinixt Confederacy were opposed to the open-pit magnesium mine in the west Kootenays, after the province's Environmental Assessment Office (EAO) had ruled that it wouldn't require an environmental assessment certificate.
The mine, owned by Calgary-based West High Yield (WHY) Resources, would be located roughly five kilometres north of the Canada-U.S. border and almost 400 kilometres east of Vancouver.
The decision, posted last week, means that construction or operations at the mine can't proceed until the groups' arguments are tested in court. The next hearing date in the matter is on May 5.
"WHY stands to succeed in defeating the [lawsuit] without arguing the merits if an injunction is not granted," Justice Dev Dley wrote in his decision.
