Whenever suspects, witnesses, or victims are summoned to the police station for any investigation, police officers must provide them with sufficient information and clarity. When contacting them by phone or other means, the police must follow proper procedures, emphasized Acting IGP Priyantha Weerasuriya.
The special circular titled “Procedures to Be Observed When Summoning Individuals to Police Stations” has been issued accordingly.
The circular further states: “Initial information often reaches police stations through various means. The responsibility to conduct inquiries based on initial information lies with the designated officer. Relevant legal provisions are outlined in Section 15 of the Criminal Procedure Code of 1979.”
“Particular attention should be paid to Sections 109 and 110 of the amended Criminal Procedure Code (Act No. 52 of 1980). Based on the necessity of the investigation, when summoning individuals—suspects, witnesses, or victims—the following matters must be communicated clearly.”
“When a suspect is summoned to record a statement, they must be duly informed of the allegations made against them.”
“When a person is summoned as a witness, the necessity for recording their statement must be explained.”
“In any other circumstance, the reason for summoning must be clearly communicated. If individuals are summoned by phone or other means, the officer in charge must act per the stipulated procedures.”
“Considering the potential pressure on complainants, victims, or witnesses, the responsible officer may decide whether to inform others about their names and related inquiries.”
“All officers under their command must be instructed accordingly,” the circular emphasizes.
